Wills & Inheritance at Mithaq

A registered will saves a family a great deal of time and worry, especially for residents with bank accounts or property in Dubai, or with young children. We listen to you about your family and what you own, explain the rules that apply to you, then draft the will in Arabic and English and arrange its registration with the competent authority.

When a loved one passes away, we guide the heirs through the inheritance certificate and the transfer of property and accounts, calmly and with written steps.

Matters we handle in this area

  • Drafting and registering wills for non-Muslims
  • Wills within the one-third limit for Muslims
  • Appointing guardians for minor children
  • Inheritance certificates and lists of heirs
  • Transferring property and accounts to heirs
  • Settling disagreements between heirs

The list is illustrative; after the consultation your lawyer tells you what applies to your case.

Do I need a will if my family is small?

Usually yes, especially if you have minor children, property or accounts in Dubai: a registered will says who looks after the children and how your assets are handled, and shortens the procedures for your family.

How long does drafting a will take?

The draft is usually ready within five working days after two meetings with you; registration is then booked according to the competent authority’s appointments.

Can I change my will later?

Yes, and it is wise to review it after any big change such as marriage, a new child or buying property.

I am Muslim. Can I leave all my assets by will?

A Muslim may leave up to one third of the estate by will to people who are not heirs; the rest is divided under the inheritance rules. We explain this in detail at the consultation.
